Terms and conditions

LushyChat offers browser-based random video chat and related features as we make them available from time to time. We may change, pause, or stop any part of the service with or without notice, except where applicable law requires otherwise.

You are responsible for your own internet connection, device, and any fees charged by third parties (such as mobile data providers).

You must be at least 18 years old to use LushyChat. Anyone under 18 is not allowed on the platform. Where local law sets a higher minimum age for services like this, you must meet that age as well.

If we find out, reasonably believe, or are told that you are under 18, we may immediately suspend or end your access, ban your account and devices, and take any other enforcement steps we think are appropriate, without prior notice where the law allows it.

If you are using LushyChat on behalf of an organization, you confirm that you have authority to bind that organization.

You agree not to:

• Harass, threaten, defraud, or harm other users, or encourage others to do so.
• Share illegal content, including sexual content involving minors, non-consensual intimate imagery, or anything that violates intellectual property rights.
• Try to interfere with or disrupt the service, other users, or our infrastructure. That includes probing, scraping, or getting around security measures without permission.
• Use the service to send spam, phishing, or malware, or to build unauthorized databases of user information.
• Misrepresent your identity in a way that is likely to mislead others in connection with harm or fraud.

We may investigate violations and take action, including warnings, suspension, or removal of access.

You keep ownership of the content you share, but you grant us a limited, worldwide license to host, process, transmit, and display that content as needed to run the service. That includes moderation, safety, and compliance with law.

You are solely responsible for your conduct and what you choose to share on camera or in any chat features. We are not a party to disputes between users.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

We do not promise that the service will run without interruption, be free of errors, or be free of harmful components. Random matching means you may run into people or content you find objectionable. You use the service at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUSHYCHAT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) WHERE NO FEES APPLY, ONE HUNDRED U.S. DOLLARS (OR LOCAL EQUIVALENT), UNLESS MANDATORY LAW PROVIDES OTHERWISE.

We may update these terms from time to time. We will post the revised version on this page and update the effective date. If a change is material, we will take reasonable steps to let you know where the product allows it. If you keep using the service after the effective date of any change, that counts as accepting the updated terms, except where the law says otherwise.

These terms are provided in English. If translated, the English version prevails in case of conflict, to the extent permitted by law.
